Prior to September 11, 2001, Americans enjoyed the privilege of living in an overwhelmingly open society with a seemingly innocent sense of security. In the wake of the atrocities wrought upon the nation by the World Trade Center and Pentagon terrorist attacks, however, emerged the realization that the American homeland is not immune from attack and that vulnerability abounds in nearly every segment of our society. This paper examines some of the concerns that the War on Terrorism raises about certain federal laws addressing each of those topics, focusing particular emphasis upon the Emergency Planning and Community Right to Know Act ("EPCRA").
