For Internet Service Providers ("ISPs") especially, the bandwidth commandeered by spamming and the resultant slowdowns in service represent an infrastructure expense of increasing dimensions. At the same time, the law of the Internet remains in some disarray, although courts and even some states have taken initial stabs at regulating spam. This White Paper presents a discussion of the problems inherent in direct electronic marketing from the perspective of both consumers and of the online community and concludes with modest recommendations for salient legislative initiatives.
