This white paper discusses key definitions and operative language used in some of the anti-spam bills currently pending before the U.S. Congress and provides a methodology for discussing spam based on five categories of characteristics, spam as unsolicited, commercial messages, sent in bulk as electronic messages across a public network. After providing this framework, the white paper's authors explore how technically inaccurate or unclear bill language potentially can result in unintended adverse consequences. As part of this analysis, the white paper cites definitions and operative language found in existing state anti-spam laws in order to provide helpful contrasts to the language in pending federal bills.
